Jury awards $1.2 million to injured BNSF worker

BILLINGS, Mont. (AP) - A District Court jury in Billings has awarded $1.2 million in damages to a former BNSF Railway employee who suffered a spinal injury two years ago.

The verdict was reached late Friday, following a two-week trial before District Judge Susan Watters.

Ken R. Dellos, 52, of Sheridan, Wyo., had worked as an engineer for the railroad for 30 years before being injured in April 2006. He filed a civil lawsuit later that year.

The jury found the railroad violated the federal Locomotive Inspection Act and was liable for Dellos' injuries. Dellos was awarded $840,000 in lost wages and $360,000 for pain and suffering, said his attorney, Fred Bremseth.

Dellos says he was relieved by the verdict. He says he's taking college classes toward a career in social work.

Michelle Friend, a Billings attorney who represented the railroad, was not available for comment Monday.
